I mopped up the water I saw with towels and left for work. I then received a flurry of emails from my landlord telling me there was massive water damage to the unit below me and that I had caused it and she was going to hold me responsible and she thought I did it on purpose. if I notified her of the problem, she sent a plumber, and then emails me and tells me it's fixed, it seems to me the damage is either due to her negligence or the plumbers. obviously me not shutting off the faucet completely wouldn't have caused any damage had her sink not been faulty. Am I liable?
I'd say less than a month has passed between when the plumber came but the fact is I actually don't stay at the property very often. She does plan to take me to small claims but since I do have emails I told her to go for it. She also wants me to move out immediately, which I'm also okay with as long as she doesn't try to make me pay out the remainder of my lease. In response to the landlord of 13 years: actually when the landlords son first showed me the unit prior to me moving in, he pointed out that the sink did in fact drain very slowly and said that he would fix it shortly (among other things he promised to fix) and the problem gradually got worse to the point where the sink was unusable. I poured draino down it and it solved the problem for a short amount of time, but I would bet money that the plumbers invoice does not list that sink. I also mentioned that I'm in the unit once a week at most, and although it's been over a week since the plumber was in, this was the first time I have used the sink. I'm not blaming the plumber, I'd bet money she didn't even have him look at it. so no, I didn't cause the clog, and while I'll gladly pay for the water itself, the damage is due her not addressing an issue that she was well aware of before I came around. and this is all recorded via email.
